1. Introduction
Welcome to Balerion. By accessing or using our website, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use this site.
These Terms apply to all purchases of products made through our website (the “Products”).
By ordering from our website, you confirm that:
• you are legally capable of entering a binding contract (e.g., at least 18 years old), and
• you have read, understood, and accepted all Terms.
We reserve the right to update these Terms at any time. Updated versions will be posted on this page. Continued use of the website indicates acceptance of the updated Terms.
2. Orders
2.1 We take reasonable care to ensure the accuracy of product descriptions, images, and pricing; however:
• colours may differ slightly due to individual screen settings,
• sizing may vary slightly due to manufacturing, and
• packaging may differ from images.
2.2 To place an order, follow the checkout instructions on our website. When you submit an order, you are making an offer to purchase the Products.
2.3 We may send an order acknowledgement email after you place your order. This does not constitute acceptance.
Acceptance occurs only when we send a confirmation/dispatch email. At this point, a contract is formed.
2.4 We may decline or cancel orders where:
• the Product is out of stock,
• payment cannot be processed,
• shipping restrictions apply,
• there is a pricing or description error, or
• suspicious or fraudulent activity is detected.
2.5 If we cannot accept your order after payment has been made, we will issue a refund for the affected items. Other than this refund, we shall not be liable for any losses arising from the cancellation.
3. Pricing
3.1 Product prices are displayed on our website. Although we make every effort to ensure accuracy, errors may occur.
3.2 If a pricing error is discovered before dispatch:
• we will contact you to confirm whether you wish to proceed at the correct price or cancel the order;
• if the error is obvious and could reasonably have been recognised as a mispricing, we may cancel the order and issue a refund.
3.3 Prices are shown in the currency displayed at checkout.
3.4 Prices include VAT/sales tax where applicable, but do not include delivery charges. Delivery costs will be shown at checkout and in our Shipping Policy.
4. Ordering & Payment
By placing an order, you confirm that:
• All information provided is accurate
• You are authorised to use the payment method
• You understand your order constitutes an offer which we may accept or decline
We accept payments via:
• Credit/Debit Cards
• Apple Pay / Google Pay
• Klarna
• Any additional payment methods listed at checkout
Your order is not confirmed until you receive an email confirmation from us.
5. Delivery
5.1 Delivery options, locations, costs, and estimated timeframes are set out in our Shipping Policy.
5.2 Delivery times are estimates only and may vary due to factors outside our control (customs, carrier delays, peak seasons, weather conditions, etc.).
5.3 Your order may arrive in multiple shipments.
5.4 If delivery requires a signature and no one is available, the courier may leave a card or instructions for re-delivery or pickup.
5.5 If you fail to rearrange delivery or collect your parcel from the courier within the required timeframe and it is returned to us, we may cancel your order and refund you, minus:
• original shipping fees, and
• any return charges billed to us by the courier.
5.6 Delivery is considered complete once the Products are delivered to the address provided during checkout or any alternative delivery address provided by you (e.g., neighbour). Responsibility and risk for the Products passes to you at that time.
5.7 You own the Products once payment in full has been received.
6. Returns, Exchanges & Cancellation
We want you to love your order. If you are not satisfied, the following policies apply:
6.1 Returns (Change of Mind)
• You have 14 days from the date you receive the Product to request and send back a return.
• Products must be:
– unworn, unused, and in original condition,
– free from stains, odors, or wear,
– with all tags attached,
– in original packaging (including shoe boxes, if applicable).
• Customers are responsible for return shipping costs unless otherwise stated.
• Return fees may be deducted from your refund.
Items that cannot be returned:
• underwear, socks, swimwear (for hygiene reasons),
• personalized or custom items,
• items missing tags or showing signs of wear.
If a return does not meet our conditions, it may be rejected and returned to you.
6.2 Exchanges
• We offer size exchanges only.
• Exchanges must be requested within 14 days of receiving your order.
• Items must meet the same conditions as returns (unworn, with tags, etc.).
• Exchanges are subject to stock availability. If the requested size is unavailable, you may receive a refund instead.
• Customers may be responsible for exchange shipping costs depending on region.
6.3 Faulty or Incorrect Items
If a Product arrives faulty, damaged, or incorrectly shipped:
• contact us at balerionclothing@gmail.com within a reasonable timeframe,
• provide your order number and clear photos of the issue.
If confirmed faulty, we will:
• issue a refund, or
• send a replacement (subject to availability), and
• cover return shipping if applicable.
6.4 Refund Processing
• Refunds are issued using the same payment method used for purchase.
• Refunds will be processed within 14 days after we receive and inspect your returned Product.
• Delivery fees are non-refundable unless legally required.
7. Events Outside Our Control
We are not responsible for delays or failure to perform obligations due to events outside our reasonable control, including but not limited to:
• strikes or industrial action,
• natural disasters,
• war or armed conflict,
• pandemics,
• utility outages,
• transportation delays.
If such an event affects your order, we will notify you as soon as possible and take reasonable steps to minimise the impact.
8. Intellectual Property
All content on this website, including logos, branding, photography, designs, graphics, and text, belongs to Balerion and is protected by intellectual property laws.
You may not reproduce, distribute, or modify any content without our explicit written permission.
9. Personal Information
Your personal information is handled in accordance with our Privacy Policy.
By placing an order, you consent to us processing your data for purposes including payment verification, order processing, and fraud prevention.
10. Limitations of Liability
To the fullest extent permitted by law:
• we are not liable for any indirect, incidental, or consequential damages,
• we are not liable for losses arising from your misuse of the website or Products,
• our total liability for any claims relating to your purchase shall not exceed the price of the Products purchased.
Nothing in these Terms excludes liability where prohibited by law.
11. Other Important Terms
11.1 These Terms do not affect your statutory rights.
11.2 We may transfer our rights or obligations under these Terms to another organisation.
11.3 Each clause in these Terms operates separately; if one is found unlawful, the remainder will continue in effect.
11.4 Failure to enforce any provision does not waive our right to enforce it later.
11.5 These Terms are governed by the laws of the region in which our business operates unless mandatory consumer laws in your location override this.
11.6 Any disputes will be subject to the non-exclusive jurisdiction of the courts in that region unless local laws allow otherwise.
